Terms & Conditions
Introduction
These Terms and Conditions govern all services provided by ND Dental Laboratory LTD. ("the Laboratory") to its clients ("the Client"). By submitting a case to the Laboratory, the Client acknowledges and agrees to be bound by these Terms and Conditions.
1. Guarantee
1.1 All dental products created at ND Dental Laboratory carry a full guarantee. This guarantee confirms that only quality materials have been used and that our carefully designed production process has been followed.
1.2 The guarantee period is six (6) months for removable appliances and twenty-four (24) months for fixed restorations, commencing from the date of delivery.
1.3 If, within the applicable guarantee period, the product proves defective under conditions of normal use, ND Dental Laboratory will provide a replacement free of charge.
1.4 The guarantee does not cover defects arising from incorrect prescriptions or fitting, nor damage caused by physical trauma, impact, or high-risk activities.
1.5 The guarantee becomes null and void if the patient does not receive their annual dental check-up, or where failure is attributable to underlying oral health conditions.
1.6 ND Dental Laboratory LTD. reserves the right to refuse a guarantee where, in its professional judgment, the requested product may not reasonably be expected to last the full guarantee period. Should ND Dental Laboratory LTD. be instructed to proceed in such cases, the Client accepts that in the event of failure, full charges for the work supplied will remain payable.
2. Remake Policy
2.1 A dental device that fits the casted master model from the original impression supplied by the Client, and which has been manufactured according to the prescription, but subsequently requires remaking, shall not be considered a remake. Such cases will be treated as new work.
2.2 To apply for a remake, all original components, the dental device, and any new components must be returned to the Laboratory for assessment.
2.3 Failure to return the originally supplied dental device will result in the case not being processed as a remake.
2.4 Charges will generally apply if the new bite or impression differs from that of the original order.
2.5 Where no obvious cause is found for the inaccurate seating of a restoration, a charge equal to fifty percent (50%) of the total cost of the restoration will apply.
3. Cancellation Policy
3.1 In the event of cancellation of laboratory work, charges will apply in accordance with the stage of the manufacturing process already completed.
3.2 Cancellation charges may include, but are not limited to, model fabrication costs, materials used, and any shipping expenses incurred.
4. Financial Settlement
4.1 Statements are generated and sent to clients on a monthly basis.
4.2 All accounts must be settled within fifteen (15) days from the date of statement.
4.3 The Laboratory reserves the right to withhold goods.
5. General Provisions
5.1. The Laboratory accepts no
liability for delays in completion or delivery caused by circumstances beyond
its reasonable control, including but not limited to late provision of impressions,
prescriptions, or other required information by the Client.
5.2. The Client is responsible for
ensuring that all impressions, prescriptions, and materials provided are
accurate and fit for purpose.
5.3. These Terms shall be governed
by and construed in accordance with the laws of [Ireland / jurisdiction],
and the parties submit to the exclusive jurisdiction of the courts of that
jurisdiction.
6. Governing Law and Jurisdiction
6.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland.
6.2 Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Irish courts.
